These Terms of Service ("Terms") govern your use of our website (capstoneanchorhq.com), services, and communications ("Services"), provided by Capstone Anchor LLC ("Company", "we", "our", or "us"), a New Jersey limited liability company located at 90 Carl Sandburg Drive, Hamilton, NJ 08690.

By accessing or using our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use our website or services.

1. About Our Company

Capstone Anchor LLC is a New Jersey-based appointment generation company serving residential roofing contractors across the United States. We provide done-for-you advertising management, automated follow-up infrastructure, and calendar booking services that deliver booked phone consultations with homeowners who have existing solar and need a roof replacement. Our contact information is listed in Section 13 below.

2. Services Provided

Capstone Anchor LLC provides appointment generation services including, but not limited to:

• Paid Ad Campaign Management: Building and managing Meta advertising campaigns targeting homeowners with existing solar systems who need roof replacement.
• Automated Follow-Up Infrastructure: CRM-based automated messaging sequences that contact leads via SMS and direct message immediately upon inquiry.
• Calendar Booking: Direct booking of qualified homeowner phone consultations onto client contractor calendars, including confirmation and reminder sequences.
• Market Exclusivity: One contractor per market for the duration of the engagement. Market access is locked upon payment of the Market Exclusivity Fee.
• Client Support: Onboarding, campaign setup, and ongoing account management support.

We reserve the right to modify, suspend, or discontinue any part of our services at any time without prior notice.

3. Use of Services

You agree to use our Services in compliance with all applicable laws and regulations, including A2P messaging compliance, the CAN-SPAM Act, the Telephone Consumer Protection Act (TCPA), and other applicable data protection laws. You must not use our services for any unlawful or unauthorized purpose.

4. SMS Messaging Terms

If you opt in to receive SMS messages from Capstone Anchor LLC:

• Opt-In Method: Consent is collected via the chat widget on our website at capstoneanchorhq.com. Opt-in is never pre-checked or assumed. No other forms on this website collect phone numbers or SMS opt-in consent.
• Opt-In Requirement: Opting in to receive SMS messages is not required to purchase or engage any services from Capstone Anchor LLC.
• Verifiable Consent: All opt-in data and consent is recorded and verifiable at the time of submission.
• Message Types: You may receive text messages (SMS) including appointment confirmations, scheduling reminders, service updates, follow-up messages, and customer support communications. With separate consent, you may also receive marketing and promotional messages related to our services.
• Message Frequency: Message frequency varies based on your activity. You may receive up to 10 messages per month.
• Message & Data Rates: Standard message and data rates may apply. Check with your wireless carrier for details.
• Opt-Out: You may opt out at any time by replying STOP to any message. You will receive a one-time confirmation, and no further messages will be sent. Marketing messages will always include opt-out language such as "Reply STOP to unsubscribe."

• Carriers: Major US wireless carriers are supported. We do not guarantee message delivery, and carriers are not liable for delayed or undelivered messages.

5. Client Responsibilities

As a client of Capstone Anchor LLC, you agree to:

• Provide accurate and complete business information during onboarding.
• Maintain an active and lawful roofing contracting business in your market.
• Use our services ethically and in compliance with all applicable laws and regulations.

6. Payment Terms

All payments are due as agreed in your service agreement. The Market Exclusivity Fee is due at signing. Monthly management fees are due per the terms of your agreement. Late payments may result in suspension of services. We reserve the right to suspend or terminate services for nonpayment.

7. Intellectual Property

All campaign materials, creative assets, automation workflows, and infrastructure built by Capstone Anchor LLC in connection with your engagement remain the intellectual property of Capstone Anchor LLC unless otherwise agreed to in writing. Client-facing assets operating under a client's brand are licensed for use during the active engagement.

8. Confidentiality

Both parties agree to maintain the confidentiality of proprietary information shared during the course of the engagement, including but not limited to campaign performance data, system architecture, pricing, and client business information, unless disclosure is required by law or consented to in writing.

9. Limitation of Liability

We provide our services "as is" and disclaim all warranties to the fullest extent permitted by law. Capstone Anchor LLC is not liable for any direct, indirect, incidental, or consequential damages arising from the use or inability to use our Services, including but not limited to lost revenue, lost business opportunities, or service interruptions caused by third-party platforms.

10. Termination

We may terminate or suspend services if you breach these Terms or the terms of your service agreement. Upon termination, access to any campaign infrastructure, automation workflows, or materials built under the engagement may be revoked.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of New Jersey, without regard to its conflict of law provisions.

12. Changes to These Terms

We reserve the right to modify these Terms at any time. Changes will be posted on our website with a revised "Effective Date" and "Last Updated" date and become effective upon posting. We encourage you to review this page regularly.
